Privacy Policy

Purpose

The purpose of this policy is to: 

  • Ensure compliance of the relevant legislation across the different jurisdictions Talent International operates in
  • Educate the business on why the adherence to Privacy Legislation is important and potential consequences of failing to comply with Privacy Legislation
  • Inform the business as to identify potential breaches and to raise awareness of the procedures in place for dealing with any alleged or actual breaches that affect Talent International Stakeholders.

Definitions

For the purposes of this policy, Personal information means information or an opinion (including information or an opinion forming part of a database), whether true or not, and whether recorded in a material form or not, about an individual whose identity is apparent, or can reasonably be ascertained, from the information or opinion.

Talent acknowledges all Privacy legislation (Privacy Laws) in all its jurisdictions across the Asia-Pacific region. This includes but is not limited to:

  • the Australian Privacy Act 1988 (Cth), including the Australian Privacy Principles (APP’s), the Notifiable Data Breach Scheme (NDP Scheme);the New Zealand Privacy Act 1993;
  • the Personal Data (Privacy) Ordinance HK (Cap 486); and
  • any applicable statutory or regulatory provisions and regulations relating to the protection and transfer of personal information.

Confidential Information means all information, howsoever recorded or stored, relating to the business, methodology or affairs of Talent and its stakeholders, which is not in the public domain.

Sensitive information means personal information about your health, racial or ethnic origin, political opinions, religious beliefs or affiliations, philosophical beliefs, membership of political, professional or trade associations or trade unions, sexual preferences or practices and criminal records.

 

Employee record or Contractor Record means personal information relating to the employment of an employee, for example:

  • health information
  • engagement, training, disciplining or resignation
  • termination of employment
  • terms and conditions of employment
  • hours of employment and salary or wages
  • recreation, long service, sick, personal, maternity, paternity or other leave
  • taxation, banking or superannuation affairs
  • personal and emergency contact details
  • performance or conduct
  • membership of a professional or trade association or trade union

The terms "personal information", "sensitive information" and "employee record" are also used in this document with the meaning that they are given in the Australian Privacy Act 1988 (Cth).
